What is the Metaverse and should your personal injury law firm be part of it? 

There has been a lot of hype lately about the “Metaverse” and what it could mean to the future of digital life as we know it. Looking forward, it’s important to understand what it is and whether your personal injury law firm would benefit from being a part of it.

Defining the Metaverse

Before we can explore its benefits to your law firm, it’s important to understand what the Metaverse is. The Metaverse is a virtual reality world where users can interact and experience things as they would in the real world. Its existence depends on Augmented Reality (AR) and Virtual Reality (VR) both of which make up what is referred to as “Metaverse space.”

In the Metaverse, virtual reality serves as a computing platform for living a second life, but this one is online. To be a part of this reality, users wear a headset that immerses them in a 3-D environment. They also carry motion-sensing controllers to interact with virtual objects and use a microphone to communicate with others. 

Matthew Ball, a private equity investor, told the New York Times recently that “It’s about being within the computer rather than accessing the computer. It’s about being always online rather than always having access to an online world.” Basically, it’s the user and his or her avatar interacting with others in a digital environment.

Right now, video games are the main platform for a somewhat advanced virtual reality. However, others see it completely changing the way users use the internet as a whole in the future. Mark Zuckerberg, trying to stay in the lead, has changed the name of his company from Facebook to “Meta,” and many marketers, businesses, organizations, and individuals believe the Metaverse holds tremendous promise and opportunity.

The Metaverse and the legal community

An Above the Law article cites potential questions for legal professionals, including personal injury lawyers, to consider as the Metaverse develops.

  • Will property rights be regulated in the Metaverse? What might be the role of contract law?
  • How will contracts be designed and executed? Will certain legal services be automated?
  • Is it possible for property to be stolen (i.e., hacked) in the Metaverse? What kind of liability might exist? What might tort law look like in this context?
  • Could disputes that are contained to the Metaverse and involve parties around the globe be resolved using alternative dispute resolution? Might that rise to a separate “Metaverse” legal system?

The present and future of the Metaverse in personal injury law

Some legal professionals, including personal injury attorneys, believe the Metaverse is actually already here and one personal injury firm has jumped right in.

The law firm’s founder absolutely believes the Metaverse provides an opportunity to advertise, connect, transact, perform, argue and collaborate in a brand new way.  He has already established a 3-D video tour of his law firm’s office in which a user comes to visit and can communicate in a limited way with the attorney’s avatar. 

Other personal injury law firms are working on hosting attorney-led webinars about their practices, which they believe will help them connect with younger generations. 

Future plans for some are to create a metaspace where a potential client or an existing client can “come in” and meet to discuss their case.

Where and how the Metaverse will be conceived and implemented by personal injury professionals is still a (large) work in process. However, to determine whether you would like your personal injury law firm to be a part of the Metaverse will require research and understanding of all the pros and cons before embracing it as the future of your digital marketing and business operation.
